DUI PENALTIES AND CONSEQUENCES IN TENNESSEE

The penalties for a DUI in Tennessee are severe and escalate with each new conviction. It is one of a handful of misdemeanor criminal offenses that requires mandatory minimum penalties be imposed. The range of punishment for DUI in Tennessee is described below:

1st Offense:

Class A Misdemeanor

  • Up to 11 months and 29 days in jail with a mandatory minimum of 48 hours incarceration. If blood results are .2 or higher, the mandatory minimum increases to 7 days incarceration.
  • $350 to $1,500 fine.
  • Loss of driver’s license for one year (a restricted driver’s license is permitted with an interlock device in your vehicle).

2nd Offense:

Class A Misdemeanor

  • Up to 11 months and 29 days in jail with a mandatory minimum of 45 days incarceration.
  • $600 to $3,500 fine.
  • Loss of driver’s license for two years (a restricted driver’s license is permitted with an interlock device only after the first year of suspension).
  • The vehicle may be seized.

3rd Offense:

Class A Misdemeanor

  • Up to 11 months and 29 days in jail with a mandatory minimum of 120 days incarceration.
  • $1,100 to $10,000 fine.
  • Loss of driver’s license for six years.
  • The vehicle may be seized.

4th Offense:

Class E Felony

  • Up to 11 months and 29 days in jail with a mandatory minimum of 150 days incarceration.
  • $3,000 to $15,000 fine.
  • Loss of driver’s license for 8 years.
  • The vehicle may be seized.
